Liability for Use of Content and Software
The use of all content, software, and/or software tools (the “Software”) is entirely at the User/Purchaser’s own risk. User/Purchaser waive all rights to assert any claim or bring any legal action against AGRO-TECH MARKETING, INC., and User/Purchaser understand they thereby may forfeit substantial rights.
AGRO-TECH MARKETING, INC. (“AGRO-TECH”) provides this Software on an “as is” basis. To the fullest extent permitted by law, AGRO-TECH disclaims all warranties, express or implied, statutory or otherwise, including but not limited to the implied warranties of merchantability, non-infringement of third parties’ rights, and fitness for a particular purpose. Without limiting the foregoing, AGRO-TECH and its suppliers make no representations or warranties about the following: the accuracy, reliability, completeness, currentness, or timeliness of the Software, and this includes but is not limited to text, graphics, links, tools, or communications provided on or through the use of the Software.
User/Purchaser understands that AGRO-TECH has no control or legal responsibility whatsoever for any third-party content referred to in the Software. As such, under no circumstances will AGRO-TECH be liable for any loss or damage resulting from the use of Third Party Content transmitted on or with the Software.
Adherence to all applicable laws and regulations in all jurisdictions, including but not limited to federal/state/provincial/local, governing professional licensing, business practices, advertising, etc. is the sole responsibility of the User/Purchaser.
In no event shall AGRO-TECH be liable for any damages whatsoever (including, and without limitation, incidental, exemplary, punitive, special, or consequential damages, compensatory, lost profits, or damages resulting from lost data or business interruption, or personal injury/wrongful death) connected with or resulting from the use of or inability to use the Software, whether based on warranty, contract, tort, or any other legal theory, and whether or not AGRO-TECH is advised of the possibility of such damages. Without limiting the foregoing User/Purchaser of the Software, on his/her own behalf, holds AGRO-TECH entirely harmless and agrees to fully defend, indemnify and hold AGRO-TECH entirely harmless from all liability arising from User/Purchaser’s use of the Software on behalf of User/Purchaser and/or of User/Purchaser’s use on behalf of any/all third party.
Reference by any User/Purchaser to any/all of the Software must include the following copyright notice: “Copyright ©2015-2025, AGRO-TECH MARKETING, INC. All rights reserved.” No part of the material accessible through the Software is to be reproduced or transmitted in any form whatsoever or by any means whatsoever, electronic, mechanical, or otherwise, including photocopying, recording, faxing, emailing, posting online, or by any information storage and retrieval system, without written permission from AGRO-TECH MARKETING, INC.
AGRO-TECH MARKETING, INC. asserts full copyright protection of the Software under United States law. The title to the Software remains with AGRO-TECH MARKETING, INC. All rights not expressly granted herein are reserved to AGRO-TECH MARKETING, INC. By continued use of Software, User/Purchaser accepts any/all modifications, and accepts the responsibility to reread the Terms for modifications. If a user violates any of the Terms, their permission to use the Software automatically terminates.
Electronic Delivery of Waiver/Release of Liability
User agrees that the electronic delivery and/or user act of using the “Software” has the same legal force and effect as a written contract with a written signature. User acknowledges they have had the opportunity to print the Waiver/Release of Liability.
Users may cancel the subscription to My Option Advantage at any time for any reason, however, no refunds of any subscription monies will be made.

(“AGRO-TECH MARKETING”, AGRO-TECH”, “we”, “our”) maintains no control and therefore takes no responsibility regarding privacy considerations or content. BY ACCESSING AND USING THE WEBSITE, THE USER IS CONSENTING TO THE COLLECTION AND USE OF INFORMATION AS DISCUSSED IN THIS PRIVACY POLICY.
I.AGRO-TECH may collect two types of information from users who access our website: (1) passively collected information gathered by analyzing page views and user navigation patterns through cookies and other analytics; and (2) actively collected information that users provide directly when they use various AGRO-TECH services, participate in various AGRO-TECH programs, and/or subscribe to AGRO-TECH services or content or otherwise make purchases from AGRO-TECH through the website.
1. Passive Information
AGRO-TECH uses page view and navigation information to ensure that users can find information on our website as quickly as possible. Also, AGRO-TECH gathers information by taking steps such as analyzing user traffic patterns throughout our website. AGRO-TECH does not attempt to identify individual visitors to our website through such analysis, but may collect data on general types of users based on domain name or browser type. This information is obtained directly from the user's web browser identification information, using cookies and similar types of passive tracking mechanisms. 2. Active Information Collections
When a user registers for or subscribes to certain AGRO-TECH programs, content and/or services, including signing up to receive newsletters and/or access to online content in the form of audio and video files, the user may be asked to provide name and contact information, billing details including credit card information, and/or demographic information (e.g., geographic location, industry).
AGRO-TECH may also use the information collected on the website for the purpose of providing users with marketing information via email. Users may opt out of receiving email messages at any time by clicking an “unsubscribe” link contained in any promotional or other emails that we send to users. Opt-out requests will be processed within 7 business days.
AGRO-TECH may also use email to provide customer service and technical support. AGRO-TECH may contact the customer using this information in an attempt to resolve an issue. It may also use the information to proactively notify customers of technical issues which may affect them.
Certain information including contact and billing information is collected from users who wish to conduct an online transaction on the website such as subscribing to access to online content and written materials. Such information also includes credit card number and security code; although, AGRO-TECH does not store such credit card information once the relevant transaction has been completed. AGRO-TECH may also direct (via direct links) a user to a third party for collection and processing of payments (e.g., PayPal Holdings, Inc. - as noted above, a user should please carefully review the privacy policies of any site directed to). AGRO-TECH may use the contact and billing information to check users’ qualifications, verify their identity, as well as for billing purposes.

AGRO-TECH keeps its customers’ personal information private and does not give it to others, unless permitted or required by law, or to third parties to provide services on our behalf and then only for use for the purposes of providing the services, or as otherwise described in this policy. AGRO-TECH does not give or sell its customers’ personal information to other companies for such companies’ own marketing purposes unrelated to AGRO-TECH.
AGRO-TECH may disclose personal information to protect the rights or property of AGRO-TECH, to enforce the R.C. THOMAS terms of use and legal notices, as required or permitted by law, or at the request of government regulators or other law enforcement officials and the courts.
